In order to showcase its vineyard and promote the diversity of Bordeaux wines, Château Larrivet Haut-Brion operates the Enriched Map application, available to the public for download on the AppStore and Android. It allows for the enhanced visualization of a vineyard map using augmented reality technology. This document is intended to inform you about the processing of personal data carried out by Château Larrivet Haut-Brion in the context of these activities. We attach the utmost importance and care to the protection of the personal data we process.

1. DEFINITIONS AND USED VOCABULARY

This section aims to define the terms that will be most used in the personal data policy.

  • "Château Larrivet Haut-Brion" ("we", "our", "us"): refers to Château Larrivet Haut-Brion, operator of the Site.
  • "User": refers to any person who has provided their personal information in order to access the content of the application or to benefit from other services provided by Château Larrivet Haut-Brion.
  • "Regulation": refers to Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of individuals with regard to the processing of personal data and on the free movement of such data ("GDPR") and Law No. 78-17 of 6 January 1978 relating to information technology, files, and freedoms.

2. COLLECTED DATA

The data collected by Château Larrivet Haut-Brion is collected during the use of the application:

  • Behavioural data - pages visited on the application, device used, equipment used, interest in content.

The data collected is processed for analysis purposes in the legitimate interests of Château Larrivet Haut-Brion in order to improve the product and service and to ensure User satisfaction.

3. DATA SECURITY

Château Larrivet Haut-Brion implements all appropriate technical and organizational measures to ensure the rights and freedoms of Users, including protecting personal data against unauthorized access, destruction, loss, alteration, unauthorized disclosure of personal data transmitted, stored, or otherwise processed.

Château Larrivet Haut-Brion has deployed a robust security system to ensure the highest security of collected data and to detect data breaches. This includes physical security of the buildings housing our systems, computer system security to prevent external access to your data, and having secure backups of your data.

When using subcontractors, Château Larrivet Haut-Brion ensures that they comply with the regulations related to data protection.

4. YOUR RIGHTS AND HOW TO EXERCISE THEM

4.1 Your Rights

In accordance with the Regulation, you have a number of rights regarding your personal data, the main ones of which are as follows:

  • Right of access: You have the right to know what data Château Larrivet Haut-Brion holds about you and to obtain a copy of it.
  • Right of rectification and erasure: You have the right to request that incorrect or outdated personal data about you be corrected and to have it deleted.
  • Right to object and to restrict processing: You have the right to object to the way Château Larrivet Haut-Brion processes your personal data or to request that it be restricted to the extent possible, subject to any compelling legitimate grounds Château Larrivet Haut-Brion may have for continuing to process them.
  • Right to object to marketing prospecting: You can object to being subject to marketing prospecting at the time of creating your Account (by checking the corresponding box in the Account creation process, by clicking on the unsubscribe link provided in each email, or through your Account or by contacting us at the contact address above). In the event of exercising the right to object to marketing profiling, the User is informed that they will continue to receive commercial solicitations, but these will no longer be targeted according to their interests.
  • Right to data portability: You can ask Château Larrivet Haut-Brion to send you the data concerning you in a structured, commonly used, and machine-readable format in order to transmit it to another data controller, provided that this is possible.
  • Right to lodge a complaint with a supervisory authority: You can contact a data protection authority if you believe that Château Larrivet Haut-Brion has not complied with the Regulation. In France, you can contact the CNIL by visiting its website: https://cnil.fr
  • Right to decide the fate of data after your death: You can formulate general or specific directives regarding the storage, erasure, and communication of your personal data.

4.2 Exercising your rights

Exercising your rights is not unlimited (we are entitled to not respond to requests that are manifestly unfounded or excessive) and each of them is subject to conditions imposed by the Regulation.

Some of these conditions are common to most of the rights you have and you will need to adhere to them with each of your requests. In this regard, we inform you of the following elements:

  • Your identity: You must justify your identity for each of your requests and specify the address to which Château Larrivet Haut-Brion should send you a response (unless you send an email, in which case we will respond to the sending address). This is a basic requirement to prevent your personal data from being disclosed to third parties. In this regard, we inform you that we are entitled to request additional information if we have doubts about your identity. The rights concerning your data are strictly personal, but if you wish for a third party to exercise them on your behalf, you must provide a mandate as well as your identity and the identity of the proxy.
  • Response time: Château Larrivet Haut-Brion will respond within a reasonable period, which we generally estimate to be one month. However, this period may be extended by two months due to the complexity or number of requests you make.
  • Free of charge: Exercising your rights is generally free of charge. However, we may ask you to cover certain costs if your requests involve significant expenses for us, especially if you request multiple copies of the information we provide to you.

In addition to these general rules, the exercise of each of your rights may be restricted or limited due to certain conditions specific to the exercise of that right.

For example, the right to erasure provided for in Article 17 of the GDPR (also known as the "right to be forgotten") can only be exercised in certain well-defined situations (there are "grounds for erasure"), unlike, for example, the right of access, which has a broader scope (but also responds to conditions).
